International Migration Law
The International Migration Law and Legal Affairs Department
has been established within IOM to strengthen and promote the Organization’s
involvement in International Migration Law (IML).
A key objective of the Department is to encourage dissemination and
understanding of IML both within IOM and with IOM counterparts, thereby
promoting IML as an essential component of comprehensive migration management
frameworks.
The Department will seek to provide support to missions on IML issues,
and coordinate, facilitate and serve as a focal point for the development
and implementation of IML project activities.
The Department’s areas of focus are divided between:
- Training and capacity building on IML; and
- Research on IML.
Activities will include the following:
Training and Capacity Building on IML

Develop and conduct training courses for government
officials, NGOs, IGOs, students and media concerning:
-
the international legal framework governing migration;
-
migration terminology;
-
rights and obligations of States and migrants:
entry, stay, naturalization, detention, exit and expulsion of
migrants;
-
legal aspects of labour migration; irregular migration,
trafficking, smuggling, and migration and security;
-
legal aspects related to health and migration;
-
regional legal frameworks.

Technical workshops on the drafting/ development of
migration legislation with government officials and legal experts.

Analysis of specific needs and possible gaps in national
migration law, and elaboration of recommendations for improvement
and development.

Awareness-raising activities concerning migrants’
rights and obligations, training for lawyers specialized in legal
assistance to migrants.

Conferences, seminars and other activities facilitating
the exchange of information, best practices and experience among governments
and other relevant stakeholders on migration law.
Research on IML

Create a database of migration-related instruments
drawing together relevant norms and decisions regulating migration
at the international, regional and national levels. The following
sources of information are being included: relevant international
conventions, regional and bilateral treaties, key decisions of international
and regional bodies, international and regional resolutions and declarations,
information on treaty ratifications, national legislation and country
information.

In cooperation with relevant services, conduct, coordinate
and facilitate research activities on IML, in areas such as:

Develop manuals on IML for government officials, NGOs
and law students.

Issue regular information bulletins on developments
in international, regional and national migration law.
